Order that: 1) The action is DISMISSED WITH PREJUDICE as frivolous and malicious and for failure to state a claim. Plaintiff is placed on notice that this is his FOURTH strike under 28 U.S.C. 1915(e)(2). 2) The Clerk is DIRECTED to note the disposition for the purposes of 28 U.S.C. 1915(g). Plaintiff is advised that he has the right to appeal the decision of the Court. Should he wish to do so, written notice of appeal must be filed with the Clerk of the Court within thirty (30) days of the date of entry hereof.
