MEMORANDUM ORDER (Conditionally Docketing Action). It is ORDERED that: this action is CONDITIONALLY docketed; Plaintiff submitted this action as petition for a writ of habeas corpus under 28 U.S.C. 2254. Plaintiff challenges the 2020 amendments to a statute that awards good time credit to Virginia inmates and claims that it is unconstitutional. (ECF No. #2 , at 4-6.) This is not an attack on the fact or duration of his confinement because Plaintiff did not "lose any already-earned good-time credits. Accordingly, the action will proceed as a civil rights action under 42 U.S.C. 1983. Plaintiff to submit statement as set out herein within thirty (30) days of entry hereof; Clerk to obtain certified copy of Plaintiff's trust fund account for 6-month period immediately preceding the initiation of this action; Plaintiff must affirm his intention to pay the entire $350.00 filing fee; Plaintiff to return the Consent to Collection of Fees form within thirty (30) days of entry hereof.
