OPINION AND ORDER - the Court FINDS that although Plaintiff qualifies as a seaman, he was not an employee of Defendants, and therefore, cannot sustain a Jones Act claim. Additionally, the Court finds had Plaintiff proved that he was an employee, Plai ntiff failed to prove any negligence on the part of Defendants and the evidence showed that Plaintiffs own negligence was the sole cause of his injury.
