FINAL ORDER GRANTING re 10 Motion to Dismiss for Lack of Prosecution; ADOPTING 14 Report and Recommendations and 15 Amended Report and Recommendations. The court does hereby adopt and approve the findings and recommendations set forth in the report of the United States Magistrate Judge filed December 12, 2013, and the amended report filed December 13, 2013. Accordingly, defendant's Motion to Dismiss is GRANTED; the final decision of the Commissioner is AFFIRMED; and the case is her eby DISMISSED WITHOUT PREJUDICE. Plaintiff is NOTIFIED, to the extent the statute of limitations prevents her from re-filing this action, her dilatory conduct may have effectively rendered this dismissal as one with prejudice.
