Filing 11 ORDER Granting 6 Motion to Dismiss. Plaintiff Winfree's state and federal law claims accrued at the time of decedent's death on September 29. 2008. Because she failed to file her suit before the applicable statute of limitations of t hree years. Plaintiffs claims are effectively time-barred. Given this result, it is unnecessary for the Court to reach the remainder of Defendants' bases for its Motion to Dismiss. Accordingly, Defendants' Motion to Dismiss is GRANTED.
