Filing 23 ORDER REPORT AND RECOMMENDATIONS re 22 Objections to Report and Recommendation. Based on the Courts finding that Petitioner is being held under § 1231(a)(6) and is entitled, on the basis of his prolonged detention, to a hearing before an i mmigration judge to determine his eligibility for release on bond, the Court (1) denies Respondents motion to dismiss and (2) grants Petitioners petition to the extent that it seeks a writ of mandamus requiring Respondents to hold a bond hearing a t which the Government will bear the burden of establishing that Petitioner is either a flight risk or a danger to the community. That hearing must occur within five (5) business days of the filing of this order, by Judge Marsha J. Pechman. (MD) |
