MEMORANDUM OPINION AND ORDER GRANTING IN PART AND DENYING IN PART DEFENDANT'S MOTION FOR JUDGMENT ON THE PLEADINGS, AND DISMISSING WITH PREJUDICE COUNTS I AND II: It is ORDERED that the Court grants in part and denies in part PNC's 22 Motion for Judgment on the Pleadings and dismisses with prejudice Carter's claims under the WVCCPA (Count I) and his negligence claim (Count II).
