MEMORANDUM OPINION AND ORDER AFFIRMING AND ADOPTING 38 REPORT AND RECOMMENDATION OF MAGISTRATE JUDGE: This Court OVERRULES the defendants 40 Objections and AFFIRMS and ADOPTS in its entirety the magistrate judges 38 report and recommendation. A ccordingly, the respondents 25 motion to dismiss or for summary judgment is hereby GRANTED. Further, the petitioners 37 motion for order of default is DENIED. It is ORDERED that the defendants 1 motion for a writ of mandamus be DENIED. Pursuan t to Federal Rule of Civil Procedure 58, the Clerk is directed to enter judgment on this matter.
