Filing 30 MEMORANDUM OPINION AND ORDER directing as follows: (1) Defendants' 24 Motion to Dismiss is GRANTED with prejudice as to all Title VII and official capacity claims against Blackwell; (2) Defendants' 24 Motion to Dismiss is GRANTED withou t prejudice as to the Title VII disparate treatment claim against the City and the § 1983 claims against the City and Blackwell in his individual capacity; (3) Defendants' 24 Motion to Dismiss is DENIED as to the Title VII retaliation claim against the City; (4) Plaintiff is given until December 3, 2010, to file a Second Amended Complaint if she should choose to do so, as further set out.
