Filing 93 MEMORANDUM OPINION AND ORDER: it is ORDERED that dfts' 89 Motion to Dismiss is GRANTED, as further set out in order; further ORDERED that: (1) dfts' 89 motion, to the extent it seeks an award of reasonable expenses, including attorney f ees, caused by Eon's failure to comply with the court's order compelling it to make its corporate representatives available for deposition testimony no later than 6/22/2012, is GRANTED pursuant to FRCP 37(b)(2)(C), as the record does not de monstrate substantial justification for Eon's failure or other circumstances that would make an award of expenses unjust; (2) dfts may file an itemized statement of such reasonable expenses, accompanied by competent supporting evidence, on or before 8/17/2012; and (3) plf may file specific objections to expenses sought by dfts, on or before 8/31/2012.
