MEMORANDUM OPINION AND ORDER it is ORDERED as follows: (1) Defendants 30 motion for summary judgment is GRANTED as to the federal-law claims (Counts IIV, VIVII)9; (2) Plaintiffs 32 motion for summary judgment is DENIED as to the federal-law claim s (Counts IIV, VIVII); (3) Defendants 30 motion for summary judgment is DENIED as moot as to the supplemental state-law claims (Counts VIIIIX); (4) Plaintiffs 32 motion for summary judgment is DENIED as moot as to the supplemental state-law claims (Counts VIIIIX); and (5) jurisdiction over the supplemental state-law claims is DECLINED pursuant to 28 U.S.C. § 1367(c)(3).
