Filing 61 MEMORANDUM OPINION AND ORDER re Supreme Manufacturing's 46 Motion for Summary Judgment: The Court has carefully considered the briefs, declarations, affidavits, and documents submitted in support of and in opposition to the motion. However, at this stage of the proceedings, this Court is not satisfied that there are no genuine issues of material fact. Additionally, Supreme Manufacturing has not shown that it is entitled to judgment as a matter of law as is required of a summary judgment movant. Celotex, 477 U.S. at 322.
