Continental Casualty's claim that it has no duty to indemnify is DISMISSED without prejudice; 2. Continental Casualty's 69 Motion for Summary Judgment on its claim that it has no duty to defend is GRANTED; 3. HomeCorp Management's counterclaim is DISMISSED with prejudice; It is further DECLARED that the Real Estate Professional Erro rs and Omissions Policy, Policy No. 25414965709, issued by Continental Casualty Company to HomeCorp Management, Inc., does not impose on Continental Casualty Company any duty to defend HomeCorp Management, Inc., Herbert Scheuer, Michael Goldner, Step hen Coleman, or W. Lloyd Strickland in the case of Hart et al. v. CWCapital, LLC, et al., CV-09-900311, pending in the Circuit Court of Houston County, Alabama, or in the case of Blumberg et al. v.
