MEMORANDUM OPINION AND ORDER that: 1. Defendants' Motions to Dismiss (Docs. 4 & 6 ) are GRANTED in PART and DENIED in PART; 2. Defendants' Motions to Dismiss (Docs. 4 & 6 ) are GRANTED as to Plaintiffs' federal claims; 3. Plainti ffs' federal claims, brought pursuant to the Real Estate Settlement Procedures Act and the Fair Debt Collection Practices Act, are DISMISSED; 4. Defendants' Motions to Dismiss (Docs. 4 & 6 ) are DENIED as to Plaintiffs' state law claims; and 5. Plaintiffs' remaining state law claims are REMANDED back to the Circuit Court of Covington County, Alabama. A separate judgment shall issue.
