Filing 15 ORDER the court ADOPTS the Recommendation of the Magistrate Judge 5 as follows: 1. Plaintiff's claims against the Alabama Department of Corrections and the Easterling Correctional Facility are DISMISSED with prejudice in accordance with the pr ovisions of 28 U.S.C. § 1915(e)(2)(B)(i), and the Alabama Department of Corrections and Easterling Correctional Facility are DISMISSED as Defendants in this case. 2. With respect to the Plaintiff's allegations against Dr. Darbouze, Warden Sconyers, and Commissioner Thomas, this case is referred back to the Magistrate Judge for further proceedings.
