MEMORANDUM OPINION AND ORDER as follows: 1) that the 18 motion to dismiss and for summary judgment filed by Great American be and is hereby GRANTED; 2) that Great American's 9 motion to dismiss and for summary judgment be and is hereby DENIE D as moot; 3) that judgment on all claims in the amended complaint be and is hereby entered in favor of Great American and against Petrey Wholesale and that Petrey Wholesale's claims be and are hereby DISMISSED with prejudice; 4) that all pending deadlines are terminated and all other pending motions are hereby DENIED as moot; and 5) that the costs of this proceeding be and are hereby taxed against the Plf.
