MEMORANDUM OPINION AND ORDER: Accordingly, for the reasons as stated and for good cause, it is ORDERED as follows: 1. That the motion to intervene (doc. # 33 ) be and is hereby GRANTED and the American Academy of Pediatrics, the American Cancer S ociety Cancer Action Network, the American Heart Association, the American Lung Association, the Campaign for Tobacco- Free Kids, and the Truth Initiative be and are hereby PERMITTED to intervene as defendants in this action; 2. That the parties join t motion to stay case (doc. # 54 ) be and is hereby GRANTED and that this case be and is hereby STAYED pending a decision by the United States Court of Appeal for the District of Columbia Circuit in Nicopure Labs LLC v. FDA, 266 F. Supp. 3d 360 (D.C . 2017) appeal docketed No. 17-5196 (D.C. Cir. Aug. 31, 2017); 3. The parties are DIRECTED to file a joint status report within forty-five (45) days of the date of a decision issued by the United States Court of Appeal for the District of Columbia C ircuit in Nicopure Labs LLC v. FDA, 266 F. Supp. 3d 360 (D.C. 2017) appeal docketed No. 17-5196 (D.C. Cir. Aug. 31, 2017); and 4. That the motion to vacate the briefing schedule (doc. # 54 ) be and is hereby DENIED as moot.
