Filing 28 ORDER: Before the Court is Plaintiff's Motion for Leave to Serve Discovery, for Expedited Discovery, and for a Scheduling Order Under FRCP 26 and 16. (Doc. #20 .) The Defendants oppose the motion in part, and therefore the motion is ripe for review. Plaintiff's motion is due to be granted in part. According to the Plaintiff, expedited discovery is warranted because he is set to be executed on 1/25/2024, by a novel method of execution that has yet to be used anywhere else in the United States. To the extent the Defendants believe that Plaintiff's discovery requests are objectionable, the Defendants may make appropriate objections to those requests. However, the Defendants are REMINDED of their obligations under FRCP 26, 33, 34, and 37. Frivolous, conclusory, general meritless, or boilerplate objections will not be tolerated. Plaintiff has demonstrated good cause for limited expedited discovery. Accordingly, it is ORDERED as follows: 1. Plaintiff's motion is GRANTED to the extent Plaintiff seeks limited expedited discovery as further set out in the order. Each party shall respond to the discovery request as soon as the responses are ready but no later than 12/6/2023. 2. If the Court denies the anticipated motions to dismiss, the parties shall conduct their planning meeting and shall submit a report of that planning meeting within fourteen (14) days of the Court's order. 3. The Plaintiff is permitted to take three (3) depositions, and the Defendants are permitted to take three (3) depositions. 4.
