MEMORANDUM OPINION AND ORDER: Based on the foregoing, Plaintiff Kevin R. McNairs unjust enrichment and RICO claims against Defendant Macon County Greyhound Park fail, but the breach of contract and fraud claims survive the present motion to dismiss. Accordingly, it is ORDERED that Defendants Motion to Dismiss the Amended Complaint (Doc. 17 ) is GRANTED as to the unjust enrichment claim in Count III and the RICO claim in Count IV, and DENIED as to the fraud claim in Count II as further set out in the order.
