MEMORANDUM OPINION AND ORDER as follows: (1) To the extent that 2 Motion tor Dismiss or, in the Alternative, Motion to Transfer seeks dismissal of this action pursuant to Federal Rule of Civil Procedure 12(b)(6), it is DENIED; (2) To the extent tha t 2 Motion to Dismiss or, in the Alternative, Motion to Transfer seeks dismissal of this action pursuant to Federal Rule of Civil Procedure 12(b)(3), it is DENIED; and (3) To the extent that Defendants' 2 Motion to Dismiss or, in the Alterna tive, Motion to Transfer seeks transfer of this action pursuant to 28 U.S.C. § 1404(a), it is DENIED; and (4)By no later than November 15, 2010, Plaintiff shall filed an Amended Complaint as further set out.
