TEMPORARY RESTRAINING ORDER: granting #2 MOTION for Temporary Restraining Order; IT IS FURTHER ORDERED THAT: 1) Guthrie, Compart, and any recipient of the Trade Secret Materials immediately cease any business activity or attempts to solicit any business opportunity that was presented by, described in, or resulted from review of the Trade Secret Materials; 2) Guthrie, Compart, and any recipient of the Trade Secret Materials shall immediately divest any benefits that they have enjoyed from use of the Trade Secret Materials; 3) Guthrie and Compart shall preserve and demand the preservation of all computers, computer tablets, phone, smart phones, external media (CD's, thumb drives, external hard drives, and the like), servers, cloud-based storage, and e-mail accounts on which they have stored any communication or information with, about, referring to and/or relating to Ham-Let, any of Ham-Let's business processes, Ham-Let's Trade Secret Materials, or any document derived from Ham-Let's Trade Secret Materials, and/or on which Guthrie has accessed Ham-Let's computers, e-mail system, or computer network; 4) Guthrie, Compart, and all those in concert with them shall avoid re-purposing, deleting, using "wiping" software, or undertaking any effort that results in any loss alteration of any data, metadata, file usage, and/or file directory information (such as, the "last accessed" dates) with, about, referring to and/or relating to Ham-Let, any of Ham-Let's business processes, Ham-Let's Trade Secret Materials, or any document derived from Ham-Let's Trade Secret Materials; 5) Guthrie and Compart shall NOT surrender or otherwise transfer to any entity other than Ham-Let, Ham-let's computer forensics expert as the court may order, and its attorneys any of the devices or data storage listed in Paragraph 4; 6) Ham-Let shall be permitted expedited discovery for information to be used at a preliminary injunction hearing; 7) The #9 Protective Order will govern the treatment of "Confidential" documents or information produced by any party or non-party during pre-trial proceedings in this litigation; 8) A hearing for further relief and objections by the Dfts is set for Tuesday, July 24, at 3:00 p.m. in Courtroom 2B of the Frank M. Johnson, Jr. United States Courthouse, One Church Street, Montgomery, Alabama; 9) The Court's Order will remain in full force and effect until such time as the Court specifically orders otherwise; 10) On or before Tuesday, July 24, Plf shall enter bond approved by the Clerk of the Court in the amount of $10,000; 11) Plf is directed to effect service of this order and the #9 Protective Order on Dfts or their counsel and file a response indicating that service has taken place.
