ORDER: The docket in this case previously identified Defendant Loyless as an unserved Defendant. However, the Court has reviewed corrections made by the Clerk, and the docket now reflects that Defendant Loyless has been served with a copy of the Complaint and Order of Procedure and that counsel has made an appearance on his behalf (Docs. #10 , #12 ) but that Defendant Loveless has not been served with a copy of the Complaint and Order of Procedure. As a result of the initial error, the Courts Order of October 19, 2021 (Doc. #14 ), inadvertently identified Defendant Loyless, rather than Defendant Loveless, as an unserved Defendant. Accordingly, Plaintiff is ORDERED to furnish the clerks office with the correct address for Defendant Loveless, not Defendant Loyless, by November 9, 2021, and the deadline for Plaintiff to furnish the correct addresses for Defendants Johnson, Shaw, Ellis, and Mosier is extended to November 9, 2021. ORDER: It appears from a review of this matter that service has not been perfected on Defendants Loyless, Johnson, Shaw, Ellis, and Mosier. The Court docket reflects that these Defendants' copies of the service package containing the Complaint and Order of Procedure were returned and marked as undeliverable. A person who has not been served is not a party to a lawsuit except in very unusual circumstances. Consequently, to maintain litigation against Defendants Loyless, Johnson, Shaw, Ellis, and Mosier, Plaintiff must furnish the clerk's office with a correct address for each individual Defendant. Accordingly, it is ORDERED that by 11/2/2021, Plaintiff must furnish the clerk's office with correct addresses for Defendants Loyless, Johnson, Shaw, Ellis, and Mosier. The Court will not continue to monitor this case to ensure that named Defendants have been served; this is Plaintiff's responsibility. If Plaintiff fails to comply with this Order, the above Defendants will not be served, they will not be parties to this action, and this case will proceed only against the Defendants on whom service is perfected.
