ORDER Plaintiff Elijah Deshawn Robinson initiated this action by filing a pro se complaint pursuant to 42 U.S.C. 1983. Doc. 1. On February 7, 2024, Plaintiff Robinson paid an initial partial filing fee of $29.00. See Doc. 4. However, Robinson must pay the entire $350.00 filing fee over time. Therefore, pursuant to 28 U.S.C. 1915(b)(1) and (2), and consistent with Robinson's signed Prisoner Consent Form (Doc. 5) (copy attached), the warden or chief jailer of Robinson's housing facility is DIRECTED to deduct and withhold from any deposits into any of Robinson's accounts at the facility a sum equivalent to 20% of the total deposits each month after the first $10.00. (That is, the first $10.00 deposited into Robinson's account each month shall go to Robinson, but the facility must deduct and withhold 20% of the monthly deposits after the first $10.00.) By the tenth day of each month, the warden or chief jailer shall pay over to the Clerk of Court all sums withheld during the previous month. The warden or chief jailer shall continue to withhold and deduct from Robinson's accounts until a total of $321.00 has been withheld and paid to the Clerk of Court to satisfy the remaining balance on Robinson's $350.00 filing fee after he paid an initial partial filing fee of $29.00. ORDER Plaintiff Elijah Deshawn Robinson initiated this action by filing a pro se complaint pursuant to 42 U.S.C. 1983. Doc. 1. Plaintiff Robinson also submitted an application to proceed in forma pauperis, supported by a certified copy of his jail or prison account statements. Doc. 2. The application is GRANTED, pursuant to 28 U.S.C. 1915(b). Robinson's inmate account statements indicate that he received average monthly deposits of $145.00 and had an average prison or jail account balance of $37.98 for the last six months. Doc. 2 at 4. Consequently, Robinson is assessed an initial partial filing fee of $29.00 pursuant to 28 U.S.C. 1915(b)(1). However, if he proceeds with this action and pays this initial partial filing fee, Robinson must make regular payments until he has paid the entire filing fee of $350.00.
