ORDER re #7 Request filed by Calvin Dwight Flannagan which the Court construes as a Motion to Commence this action without payment of an Initial Partial Filing Fee, and so construed, said Motion is GRANTED. Pursuant to 28 U.S.C. 1915(b)(1) and (2), and consistent with the prisoner's signed #4 Prisoner Consent Form, the Warden is hereby directed to withdraw from Prison Account of Calvin Dwight Flannagan until the full Initial Partial Filing Fee of $29.85 has been paid in full. Following payment of the Initial Partial Filing Fee, the warden or chief jailer is further DIRECTED to deduct and withhold the remaining balance of the Filing Fee to be paid to the Clerk of the Court to satisfy the docket fee required by the filing of this action. On October 31, 2018, the plaintiff returned the signed Prisoner Consent Form, but he has failed to pay the initial partial filing fee. The plaintiff is hereby ORDERED to pay the initial partial filing fee in the amount of $29.85 within fifteen (15) days from the date of this Order.
