August 23, 2023 Opinion or Order Filing 7 ORDER - In its August 2, 2023 Order, which was mailed to Plaintiff via first class mail, the Court explained that Plaintiff's Complaint is due to be dismissed because it did not contain any factual allegations (Doc. #3 ). The Court gave leave until August 16, 2023 for Plaintiff to file an amended complaint curing these deficiencies. The Court also denied Plaintiff's motion to proceed in forma pauperis with leave to refile upon submission of an amended complaint. Since that Order, Plaintiff has made no attempt to amend his Complaint to state a colorable claim against the Defendants. Accordingly, this action is DISMISSED WITHOUT PREJUDICE. August 2, 2023 Opinion or Order Filing 3 ORDER Plaintiff Gavin Howard has filed a pro se complaint against Pickens County, Alabama; Keith Booty Cox; Jeremy Herd; Jordan Powell; Scott Foster; and David Abston. Doc. 1. Howard also submitted a motion for leave to proceed in forma pauperis. Doc. 2. For the reasons discussed below, Howard will be required to file an amended complaint. The court will deny the motion to proceed in forma pauperis with leave to refile upon the submission of an amended complaint. Accordingly, it is ORDERED that: 1. On or before August 16, 2023, Howard shall file an amended complaint that cures the deficiencies and complies with the instructions outlined above. Howard is specifically cautioned that failure to timely file an amended complaint in accordance with these directives and by this deadline will result in the dismissal of this action. 2.
