The Motion is granted with respect to plaintiff's Title VII claim of a racially hostile work environment, and that claim is dismissed with prejudice. The Motion is denied with respect to plaintiff's Title VII claim of retaliation. This matter remains set for a Final Pretrial Conference on April 9, 2013 at 1:30 p.m., with non-jury trial to follow in May 2013. To date, the lawyer who filed a Notice of App earance on plf's behalf has failed to submit the paperwork to be admitted to practice in this Court.
