MEMORANDUM OPINION AND ORDER re MOTIONS for Summary Judgment that as to Plaintiff's Eighth Amendment violation for claim of excessive force and state claim of assault and battery, summary judgment should be granted in part and denied in part; as to Plaintiff's Eighth Amendment failure to protect claim, summary judgment should be granted in part and denied in part; as to Plaintiff's Eighth Amendment violation for claim of denial/delay of medical care should be GRANTED in favor of a ll Defendants; Slander and harassment claims, are to be DISMISSED as to all Defendants; Declaratory and/or Injunctive Relief, is declared DISMISSED; and Implimentation of the procedures used, is DISMISSED as to all Defendants as set out. It is furthe r ORDERED that this case be REFERRED BACK to the Magistrate Judge for consideration re [ 134 MOTION for Extension of Time to File Answer and Special Report filed by Michael Harrison, Mallorie Mixon.
