March 19, 2024 Opinion or Order Filing 14 TEXT-ONLY ORDER: In light of the Plaintiff's #13 Position Regarding Settlement, briefing on the pending #9 motion to dismiss or for more definite statement is SUSPENDED indefinitely. Plaintiff to file appropriate voluntary dismissal paperwork under Fed. R. Civ. P. 41(a), or a report providing the status of settlement finalization and stating how much additional time will be needed, no later than 4/17/2024. If nothing is filed by that deadline, the Court will assume that the settlement has been finalized and will forthwith enter an order dismissing all claims in this action with prejudice sua sponte under Fed. R. Civ. P. 41(a)(2) and directing each party to bear its own costs except as otherwise agreed. See Pontenberg v. Bos. Sci. Corp., 252 F.3d 1253, 1256 n.1 (11th Cir. 2001) (per curiam) ("a district court need not await a motion from a plaintiff to permit voluntary dismissal and may act sua sponte to dismiss under Rule 41(a)(2)").
