April 9, 2024 Opinion or Order Filing 33 TEXT-ONLY ORDER: On April 8, 2024, Defendants Calvin J. Calvin and Calvin & Associates, Inc. filed Motions to Dismiss for Improper Service Pursuant to Rule 12(b)(5). (Docs. 32, 33). Plaintiffs are ORDERED to file briefs in response to Defendants' motions on or before April 22, 2024. Defendants' reply briefs, if any, must be filed on or before April 29, 2024, at which time the Court will take the motions under submission. Once the motions are taken under submission, no further briefs or submissions related to the issues raised in the motion may be filed without leave of court. As previously advised, this action has been assigned to the undersigned Magistrate Judge for all purposes. (Doc. 9). Unless a Request for Reassignment to a United States District Judge is sent by email to Edwina_Crawford@ alsd.uscourts.gov, on or before April 29, 2024, the undersigned will accept the parties' actions as implied consent and treat this as a consent case pursuant to 28 U.S.C. 636(c). See Roell v. Withrow, 538 U.S. 580, 590 (2003); Chambless v. Louisiana-Pacific Corp., 481 F.3d 1345, 1350-51 (11th Cir. 2007). If neither party requests reassignment, the parties should complete the Court's form Consent to the Exercise of Jurisdiction by a United States Magistrate Judge and return it to the Court by May 6, 2024. The Clerk is DIRECTED to send to each party a Request for Reassignment to a United States District Judge form and the Court's Consent to the Exercise of Jurisdiction by a United States Magistrate Judge form.
