Filing 9 RESPONSE TO ORDER TO SHOW CAUSE re: #8 Order to Show Cause by Plaintiff Jose Luis Tapia. (63 pages) (WLP) |
Filing 8 ORDER - Plaintiff is ORDERED TO SHOW CAUSE, in writing, within 30 days of the date this Order is filed, why the dismissals of his prior actions or appeals do not preclude his in forma pauperis status under 1915(g). Plaintiffs written response shall be limited to this issue only. If Plaintiff fails to either pay the $350.00 filing fee and $52.00 administrative fee or file a response to this Order to Show Cause within 30 days of the date this Order is filed, the Clerk of Court must enter a judgment of dismissal of this action without further notice to Plaintiff and without prejudice to Plaintiff filing a complaint in a new case accompanied by prepayment of the full $402.00 filing and administrative fees and must deny any pending unrelated motions as moot. See document for complete details. Signed by Chief Judge G Murray Snow on 3/20/2023. (WLP) |

Filing 1 ORDER: This case is severed into individual actions, one for each named Plaintiff. The Clerk of Court must file a copy of this Order in each new case. The rulings in this Order shall apply to each new case. The Clerk of Court must file a copy of: Plaintiff Mitchell's Application to Proceed In Forma Pauperis in Mitchell's new individual case; Plaintiff Jordan's Application to Proceed in Jordan's new case; Plaintiff Tapia's Application to Proceed in Tapia's new case; Plaintiff Lincoln's Application to Proceed in Lincoln's new individual case; and Plaintiff Ward's Application to Proceed in Ward's new individual case. The individual Plaintiffs must proceed independently from this point and will not be regarded as co-plaintiffs, except upon further order of the Court. All further pleadings, motions or other papers submitted for filing by an individual Plaintiff in his or her separate case must be signed by the individual Plaintiff, or they will be stricken. The Clerk of Court must file a copy of the Complaint and this Order in each new case. The rulings in this Order shall apply in each new case. The Complaint is dismissed without prejudice. Each Plaintiff has 30 days to file an amended complaint in his individual case, asserting only his claims using the court-approved form complaint for use by prisoners and in compliance with the Instructions. If a Plaintiff fails to file an amended complaint in his individual case within 30 days, the Clerk of Court must enter a judgment of dismissal of that action without prejudice, and without further notice to the Plaintiff and deny any pending unrelated motions as moot. The Clerk of Court is directed to use the addresses reflected on Plaintiffs Jordan, Tapia, Lincoln, and Ward as the mailing addresses of these Plaintiffs when mailing a copy of this Order and the case-opening paperwork in the new actions. The Clerk of Court must mail a copy of the Complaint to each individual Plaintiff. See document for further details. Signed by Senior Judge Susan R Bolton on 2/13/2023. (REK) |
