Because the Court finds that the USCIS's interpretation of 8 USC 1255 was neither arbitrary nor capricious, it follows that Defendants properly denied Plaintiffs' applications for adjustment of status. Accordingly, there are no triable issues left to be resolved, and the Court GRANTS Defendants' request for summary judgment. Defendants shall file a "Proposed" Judgment withint seven (7) days of this Order. This Order is not intended for publication or for inclusion in the databases of Westlaw or LEXIS. (jp)
July 14, 2009 Opinion or Order Filing 16 MINUTES IN CHAMBERS before Judge A. Howard Matz: On 7/13/2009, the parties file a Joint Status Report stating that the "will file Cross Motion for Summary Judgment by or on 8/3/2009," (see attached Minute Order for further information). The Court thus ORDERS that only Plaintiffs may move for summary judgment. They shall do so on or before 8/3/2009. Defendants in their opposition papers can assert the bases for why they think judgment should be entered for them. (jp)
July 2, 2009 Opinion or Order Filing 14 MINUTES IN CHAMBERS before Judge A. Howard Matz: On 6/19/2009, the Court denied the government MOTION to Dismiss this action for Lack of Jurisdiction 8 . In light of the procedure and practice of the immigration court in these two cases, the Court O RDERS the parties to file a second joint status report by not later than 7/13/2009 suggesting an accelerated briefing schedule on the merits of this action. If the government wishes to represent that the Court should not pursue an accelerated schedule because even if the Court ultimately remands this matter to the USCIS for reconsideration, the deportation proceedings will not in fact be terminated, it may do so in the joint status report.
