ORDER DISMISSING CASE by Magistrate Judge John E. McDermott, re Stipulation to Dismiss Case 43 . The Court is in receipt of the parties' Joint Stipulation in Support of Dismissal of Entire Action, With Prejudice pursuant to Fed. R. Civ. P. 41 (a)(1)(A)(ii), filed December 9, 2013. Pursuant to Rule 41(a)(1)(A)(ii), a plaintiff "may dismiss an action without a court order by filing... [] a stipulation of dismissal by all parties who have appeared." Accordingly, by the filing of the Stipulation, Plaintiff has dismissed the above-referenced matter with prejudice. See Fed. R. Civ. P. 41(a)(1)(A)(ii); Concha v. ORDER TO SHOW CAUSE by Magistrate Judge John E. McDermott, Plaintiff is hereby ORDERED TO SHOW CAUSE why this action should not be dismissed for failure to prosecute and/or failure to comply with a Court order. Plaintiff shall file a written response to this Order to Show Cause no later than October 17, 2012. Plaintiff may respond by filing the required proof of service or by setting forth compelling reasons why service has not been effectuated in a timely manner. The Order to Show Cause will st and submitted upon the filing of Plaintiffs response. Plaintiff is advised that failure to file a proof of service or other response to this Order to Show Cause will result in the Court recommending that the case be dismissed for failure to prosecute and/or failure to comply with a Court order.
