Given the Complaint's failure to state any federal claim that might furnish a basis for this Court's jurisdiction, the Court declines to rule on the other issues raised in Defendants' Motion to Dismiss. Plaintiff's application for an extension of time to serve unserved Defendants is denied without prejudice for the same reason. If Plaintiff still wishes to pursue this action, he is granted thirty (30) days from the date of this Order within which to file a First Amended Complaint. See Order for details. (dml) |
