Filing 14 MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER DISMISSING ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(B). Plaintiff Ebony Henderson brings this action against Defendant Target Corporation. The Court denied Plaintiff's request to proceed in forma pauperis and dismissed the Complaint for failure to articulate a basis for the Court's jurisdiction and failure to state a claim #8 . The Court ordered Plaintiff to file an amended request to proceed in forma pauperis and amended complaint within 30 days and warned that failure to do so would result in dismissal of the case without prejudice. (Id.) Plaintiff did not timely do so. Instead, orders and notices sent to Plaintiff's address of record were returned by the United States Postal Service as undeliverable. (ECF Nos. 9-13.). Having considered these factors, dismissal is warranted for failure to prosecute, failure to comply with a court order, and failure to keep the Court apprised of Plaintiff's address. The case is dismissed without prejudice. This Order shall constitute notice of entry of judgment pursuant to Federal Rule of Civil Procedure 58. Pursuant to Local Rule 58-6, the Court directs the Clerk to treat this Order, and its entry on the docket, as an entry of judgment. (Made JS-6. Case Terminated.) (lc) |
