Filing 10 ORDER ON REQUEST TO PROCEED IN FORMA PAUPERIS (NON-PRISONER CASE) #1 by Judge Otis D. Wright, II: On the question of indigency, the Court finds that the party who filed the Request: has not submitted enough information for the Court to tell if the filer is able to pay the filing fees. This is what is missing:Plaintiff's Request is incomplete, largely unintelligible, and filed on a Southern District of New York form: (claim under indigency statute must "state the facts as to affiant's poverty with some particularity, definiteness, and certainty" ). Additionally, Plaintiff indicates in the Request that he is incarcerated, but his address and other filings appear to show he is not. Ruling on the Request is POSTPONED for 30 days so that the filer may provide additional information. Within 30 days of the date of this Order, the filer must do the following: (1) if Plaintiff is not incarcerated as a prisoner, file a completed Central District of California ("CDC") Form CV-60 IFP Request, included with this Order; OR (2) if Plaintiff is incarcerated as a prisoner, file a completed CDC Form CV-60P IFP Request, included with this Order; OR (3) pay the full filing fee of $402.
