Audero: The Court hereby ORDERS as follows: (1) As Plaintiff Nonnette is the only Plaintiff who complied with the Courts Order to advise whether the Plaintiff would remain in this lawsuit, Plaintiff Nonnette's Motion to Proceed (ECF No. 9) is GRANTED. (2) With respect to Plaintiff Nonnette's Motion to Compel, the Court finds that the Motion to Compel is unrelated to the harm alleged in the Complaint and therefore is not actionable. As such, Plaintiff Nonnettes Motion to Compel (ECF No. 8) is DENIED. (3) The Court sua sponte EXTENDS Plaintiff Nonnettes deadline to either pay the $400 filing fee or file an application to proceed in forma pauperis to September 7, 2020. (4) As Plaintiff Nonnette has not yet paid the filing fee or been approved to proceed in forma pauperis, the lawsuit is not yet active and Plaintiff Nonnette's Stay Request (ECF No. 10) is PREMATURE. Audero: On June 15, 2020, Plaintiffs Narvis Nonette, William Roberts, and Richard Cooper (each, a "Plaintiff" and collectively, "Plaintiffs") filed a putative class action lawsuit pursuant to 42 U.S.C. 1983 ("Complaint"). (Compl., ECF No. 1.) The Court hereby ORDERS as follows: (1) Within thirty (30) days after this order, each Plaintiff separately must do one of the following: (a) advise the Court that he or she will proceed with this lawsuit (only one Plaintiff may remain in this action); (b) file a Notice of Dismissal (form attached); or (c) advise the Court that he or she wishes to sever his or her claims into a separate prisoner civil rights action. Failure to notify the Court of how each Plaintiff would like to proceed will result in a recommendation that his or her claims be dismissed.
