Drozd on 10/13/2009 ORDERING The claims of pltfs Dianne Nelson and Ronald Wright are SEVERED from the claims of pltfs Hannah MacKay, Daniel Schoenstein, Lexi Schoenstein, Collin Schoenstein, and Elizabeth Chri stopher; Pltfs Hannah MacKay, Daniel Schoenstein, Lexi Schoenstein, Collin Schoenstein, and Elizabeth Christopher will proceed in case 2:07-CV-1806 GEB DAD PS, while pltf's Dianne Nelson and Ronald Wright will proceed in two separate civil actio ns; The Clerk of the Court is directed to open two new civil actions for pltfs Nelson (2:09-CV-2862 GEB DAD PS) and Wright (2:09-CV-2863 GEB DAD PS); Assign each of the new actions to the same district judge and magistrate judge to whom case No. 2:07 -CV-1806 GEB DAD PS is assigned and make appropriate adjustment in the assignment of civil cases to compensate for such assignment; File and docket a copy of this order in this case and in the new actions opened for pltfs Nelson and Wright; Place a c opy of the complaint 1 filed 8/31/2007 in the new actions opened for pltf's Nelson and Wright; Place a copy of pltf Wright's 2 application to proceed in forma pauperis filed 8/31/2007 (pages 1 and 2 only) in the action opened for him, 2 :09-CV-2863 GEB DAD PS; Place a copy of pltf Nelson's application to proceed in forma pauperis filed 8/31/2007 (pages 3 and 4 only) in the action opened for her, 2:09-CV-2862 GEB DAD PS; Send pltf Nelson a notice of the case number assigned to h er individual action; and Send pltf Wright a notice of the case number assigned to his individual action; The Clerk of the Court is directed to send pltf Nelson a form Application to Proceed IFP in a civil case; Pltf Nelson is GRANTED 20 days from th e date of this order to file a new application to proceed IFP, using the form provided by the court with this order. The new application must bear the case number assigned to pltf Nelson's own individual case. Failure to file a timely new applic ation to proceed IFP in accordance with this order will result in a recommendation that pltf Nelson's action be dismissed without prejudice; and Pltf Wright is GRANTED 20 days from the date of this order to file a notice of change of address pro viding an address where mail can be sent directly to him, or show good cause for not doing so. The notice of change of address or declaration of good cause must bear the case number assigned to pltf Wright's individual case. Failure to file a timely notice of change of address or declaration of good cause will result in a recommendation that pltf Wright's action be dismissed without prejudice.(Reader, L) |
