ORDER signed by Magistrate Judge Craig M. Kellison on 10/31/14 ordering plaintiff may file an amended complaint within 30 days of the date of service of this order. If plaintiff chooses not to file an amended complaint, this action will proceed aga inst defendants Cates, Swarthout, Starke, Peterson, Cappel, Hardy, Author, Blackwell and Freese. If no amended complaint is filed within 30 days of the date of this order, defendants shall file a response to the complaint within 30 days thereafter. If plaintiff chooses to file an amended complaint, the court will issue a separate order setting a response deadline for the defendants. Within 30 days of the date of this order, plaintiff shall inform the court as to the status of service as to de fendants Cates, Starke and Freese. If plaintiff needs assistance to complete service as to defendants Cates, Starke, and/or Freese, he may submit within 30 days from the date of this order, an application to proceed in forma pauperis and request that the U.S. Marshal assist in completing service of process. The clerk of the court shall send plaintiff a form application to proceed in forma pauperis by a prisoner. (Plummer, M)
