ORDER: The Report and Recommendation (Doc. 21 ) is ADOPTED in part. The Motion to Dismiss (Doc. 15 ) is DENIED with respect to the First Amended Complaint's First Amendment retaliation claim, and GRANTED with respect to the First Amended Compl aint's remaining claims. The First Amended Complaint's Eighth Amendment cruel and unusual punishment claim; false imprisonment claim; Fourteenth Amendment due process claim; and Fourteenth Amendment equal protection claim are DISMISSED with out prejudice and with leave to amend.
