Filing 112 ORDER granting 105 Motion for Order to Confirm Settlement and 105 Motion to Dismiss Claims. The Settlement Agreement is approved as a good faith settlement. Pursuant to sections 877 and 877.6 of the California Code of Civil Procedure, CERCLA sect ion 113(f)(1), and approach taken by Section 6 of the UCFA, and all claims for contribution or equitable indemnity against the parties arising out of the facts alleged in the complaints, counterclaims, or cross-claims, regardless of when such claims are asserted or by whom, relating to Covered Matters under the Settlement Agreement are hereby barred. All claims, cross-claims, counterclaims, or any other claims that have been made by and between the parties are dismissed with prejudice. Court sh all retain jurisdiction over both the subject matter of this Settlement Agreement and the parties for the duration of the performance of the terms and provisions of the Settlement Agreement. The parties shall bear their own attorneys' fees and costs. The Clerk shall file this Order in both actions.
