October 27, 2009 82 Opinion or Order of the Court ORDER: Yoon's request for relief pursuant to California Code of Civil Procedure Section 708.410 et seq. is denied. The Ex Parte Application for Order Enforcing Settlement Agreement (Doc. 75 ) and the Counter Ex Parte Application for an Order of Defendants' Compliance with the Settlement Agreement (Doc. 78 ) are each granted in part and denied in part. Plaintiff will not be required to render performance pursuant to the settlement agreement until Defendants have delivered the settleme nt check to Plaintiff, issued the Adopt-a-Highway permit referenced in provision two of the settlement agreement, and, no later than 14 days from the date of this Order, a Public Information Officer for the State has complied with provision five of t he settlement agreement. No later than 15 days after this Order is filed, the parties shall file either: (1) a joint motion to dismiss this action, or (2) a status report as to the performance of the material provisions of the settlement agreement. February 7, 2008 6 Opinion or Order of the Court ORDER Denying Motion For Issuance Of A Temporary Restraining Order And Setting Briefing Schedule For Motion For Preliminary Injunction: Pending before the Court is Plaintiff's request for a temporary restraining order (2, 5). The Court finds this matter suitable for submission on the papers and without oral argument. Plaintiff's motion for a temporary restraining order (2, 5) is denied. The Court sets the briefing schedule for Plaintiff's motion for a preliminary injunctio n to enjoin Defendants from assigning Plaintiff's former Adopt-a-Highway location to a third party (2): (1) Defendants shall file a response to the motion on or before 2/29/08; (2) Plaintiffs may file a reply in support of the motion on or before 3/7/08; (3) The parties shall appear for a hearing on the motion on 3/14/08 at 01:00 PM.
