Filing 45 ORDER Granting St. Paul Surplus Lines Insurance Company's 20 Motion for Summary Judgment; and Denying Peerless Insurance Company's 18 Motion for Summary Judgment: The Court finds that Peerless' claims for equitable subrogation, equ itable indemnification, and equitable contribution fail as a matter of law. The Court finds that St. Paul is entitled to reimbursement of the expenses paid in the defense of EMK prior to St. Paul withdrawing that defense in the amount of $30,022.64.
