ORDER Granting 10 Defendant's Motion to Dismiss the Second Cause of Action and to Strike the Request for Punitive Damages: If plaintiff intends to file a second amended complaint in conformity with this Order, he shall do so within 10 days of the filing of this Order. If plaintiff does not timely file a second amended complaint within the time provided, defendant shall file an answer to the remaining portions of the FAC within the time provided under the Federal Rules of Civil Procedure.
