Filing 107 ORDER granting 98 Motion to Dismiss Plaintiffs' Third Amended Complaint. Based on the reasons stated herein, the Court grants Defendants' motion to dismiss. Plaintiff's requests under Section 501 of the Copyright Act for statutory da mages, enhanced damages, and attorneys fees are dismissed with prejudice; Plaintiff's second, third, fourth, and fifth causes of action are dismissed with prejudice; Plaintiffs sixth cause of action is dismissed without prejudice and with leave to amend; Plaintiff shall file a fourth amended complaint in compliance with this Order by 7/16/2010.
