Filing 28 ORDER Granting Defendants' 24 Motion to Dismiss: The first cause of action is dismissed with prejudice as against Defendant EMC and dismissed without prejudice as to Defendant Bear Sterns. The second cause of action is dismissed without prejud ice. The fifth cause of action is dismissed without prejudice as to the claim under 12 USC 2605(e) and dismissed with prejudice as to the claim for accounting. The sixth cause of action is dismissed with prejudice. The seventh cause of action is dismissed without prejudice.
