Filing 30 ORDER Re Motions for Summary Judgment. Defendants do not have a duty to defend Osborne in the underlying action; Osborne's breach of contract and breach of the implied covenant of good faith and fair dealing claims cannot proceed. Accordingly, this order resolves all outstanding issues in this matter, and the Clerk of Court is hereby instructed to terminate the case file and enter judgment in favor of Defendants North American Capacity Insurance Company and First Specialty Insurance Corporation, and against Plaintiff Osborne Development Corporation.
