May 10, 2011 Opinion or Order Filing 21 ORDER granting in part and denying in part 5 Motion to Dismiss. Based on the foregoing stated herein, Defendant Stephanie Buchert, M.D.'s Motion to Dismiss Plaintiff's claims against her is granted in part and the Court hereby dismisses w ith prejudice Plaintiff's first, second, third, fourth, and eighth claims against Defendant Buchert, as well as Plaintiff's claim for punitive damages.
