Filing 3 ORDER Denying 2 Motion to Proceed In Forma Pauperis as Barred by 28 U.S.C. §1915(g); and Dismissing Case for Failure to Pay Filing Fee Required by 28 U.S.C. §1914 (a). The Court hereby DENIES Plaintiffs Motion to Proceed IFP [ECF No. 2] pursuant to 28 U.S.C.§ 1915(g); DISMISSES this action without prejudice for failure to pay the $350 civil filing fee required by 28 U.S.C. § 1914(a); and CERTIFIES that an IFP appeal from this Order would be frivolous and therefore, would not be taken in good faith pursuant to 28 U.S.C. § 1915(a)(3). The Clerk shall close the file. Signed by Judge Anthony J. Battaglia on 04/13/11. (All non-registered users served via U.S. Mail Service)(cge)(mam). |
