Filing 25 ORDER granting Defendant McEwan, Davidowski, Shelton and Stone's 13 Motion to Dismiss for failing to state a claim pursuant to FRCP 12(b)(6). Court dismisses all purported claims as to Dft Raske pursuant to FRCP 4(m) and 25(a)(1). Because Cour t finds amendment to Pla's claims would be futile, leave to amend in this matter is denied.
