MEMORANDUM DECISION AND ORDER. Court finds that Dft Morales's use of force was objectively reasonable under the Fourth Amendment. Pla failed to prove by a preponderance of the evidence an essential element of his claims for excessive force under Bivens and assault and battery under the FTCA.
